We are committed to protecting your privacy as an online visitor to our website and as a participant to our events. We use the information we collect about you to maximise the services that we provide to you.  We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles.

All information gathered and stored by Itchy Goat Art is saved in line with the Privacy Act 1988 (Cth) and the Privacy and Personal Information Protection Act (PPIPA) NSW 1998. 

 

STORAGE & SECURITY:

Itchy Goat Art saves all privacy information gathered and stored for tax and participant identification on an external hard drive off-line to the internet which helps to ensure maximum protection from details being hacked or used by any unauthorised third party.

The details are stored within New South Wales Australia and will remain here off-line, encrypted and protected.

Itchy Goat Art will take all reasonable steps to ensure that any personal details gathered or stored are safe and secure, including restricting unauthorised access with appropriate user authentication methods and making appropriate backups.

Any details held by Itchy Goat Art may be viewed at a suitable time and maybe corrected by the participant upon request.

 

USE OF INFORMATION:

You may provide basic contact information such as your name, phone number, address, and email address to enable us to send information or take a booking for one of our services.  We may also collect from time-to-time other information such as feedback, change of details, email preferences, survey results or other communications between us.

We may use personal information collected from you for the purpose of providing you with direct marketing material, special events, updates regarding our website and business and information in the form of a newsletter.  Itchy Goat Art may send out future marketing or upcoming events of interest. However, recipients may unsubscribe or opt out from these communications at any time through the email received or by emailing Itchygoatart.com.au.

Details gathered, held, stored by Itchy Goat Art includes the personal information obtained on the booking form for the purpose of participant identification and business tax implications. 

Your information will not be used for any other purpose, subject to permitted disclosures as set out in this Privacy Policy.

Itchy Goat Art may send out future marketing or upcoming events of interest. However, recipients may unsubscribe or opt out from these communications at any time.

 

CONFIDENTIALITY:

We will use all reasonable means to protect the confidentiality of your personal information while in our possession or control.  We will not knowingly share any of your personal information with any third party.

The information that is collected and kept by Itchy Goat Art are only accessed by Employees of Itchy Goat Art. We do not and will not sell or deal in personal information, where it is given to any third party for any reason.

 

DISCLOSURE OF YOUR INFORMATION:

We may from time to time need to disclose certain information, which may include your personal information, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.  Also, we may use your personal information to protect our rights, property or safety, or that of our customers or third parties.

If there is a change of control in our business (whether by sale or other) customer information, which may include your personal information, could be disclosed to a potential purchaser under a confidential agreement.  We would only disclose your information in good faith and where required by any of the above circumstances.

 

CHANGE IN PRIVACY POLICY:

To ensure our Privacy Policy remains current and up to date with changing legislation, this policy is subject to change.  We may modify this policy at any time and all changes will be effective immediately upon uploading onto this website.  Please review our Privacy Policy.

Where a participant feels that Itchy Goat Art has breached the Australian Privacy Principles, they may make a complaint directly to Itchy Goat Art in writing and we will endeavour to work through it with you to a satisfactory result.

If you wish to raise a formal complaint regarding the use of your personal information, we will seek to work with you to resolve your complaint within 30 days.  If your complaint is unresolved within 30 days, you have the right to take your complaint to the Office of the Australian Information Commissioner: https://www.oaic.gov.au/contact-us

Terms & Conditions of Use

It is very important that you read and understand this document carefully before you book your visit as it sets out the clear boundaries and services we are providing.

 

You accept this agreement as a contract when you book and pay for your ticket.

 

We want to provide an enjoyable creative arts event for all our visitors while bringing them together through mutual respect and happiness given by our animals. We are a family-owned business who want to share with our visitors include children of all ages, parties, community groups, those with special needs, and anyone who needs a cuddle from something cute, soft and fluffy while creating an original artwork.

 

1. Parties to the agreement

This agreement is a contract is between: 

Itchy Goat Art and the visitors when you book your visit.

Our services are offered in compliance with Australian Consumer Law.

 

2. Unacceptable Behaviour

We do not welcome those who don’t respect the safety of our animals or other humans, who are not willing to share and be patient, or who don't follow our rules, which are set out in this agreement. Our rules are there to ensure that everyone has an enjoyable time, and no-one is harmed including 2 and 4 legged participants. We are sure you will agree our rules make sense.

 

If you don’t think our requirements are reasonable, please don’t buy a ticket.

 

We reserve the right to demand that you to leave our farm without refund if you:

<>····engage in abusive behaviour to us or any other person.

 

If you are told that you need to leave, you must do so quickly and calmly without making a fuss or spoiling the experience for others who are respectful of our rules. Failure to do so may result in the police being called. Your agreement that this requirement is entirely reasonable is an essential condition of being granted entry to our farm as a visitor.

 

3. What is included in your visit

A time specific session as stipulated on your booking.

While each visit may be different, depending on the time of year, the weather and our animals’ needs. In general, you can expect to enjoy pats, cuddles and hand feeding with a range of miniature goats and at different times other chosen farm animals and the completion of an original artwork.

 

4. Payment Terms

Current entry fees and availability are listed on our website Itchy Goat Art.  All prices are inclusive of GST.

 

It is essential to book and pay for your visit in advance through our website.

 

All persons entering the Attraction must have a valid entrance ticket which must be retained during your visit. As the tickets are non-transferable, accordingly they may not be sold or passed to any third party.

 

Once purchased, a booking ticket may not be transferred, assigned or re-sold to any third party.

 

We do not accept walk-in visitors who have not booked in advance under any circumstances.

5. Expectations

We take our responsibilities very seriously. You can expect us to offer you a fun-filled experience in a controlled environment. We remain responsible for our animals at all times and pride ourselves on presenting happy, healthy animals, appropriately supervised, in a stress-free environment.

 

Our visitor area is clean, tidy, safe and secure, with suitable enclosures and fencing. Visitors are required to stay in the enclosed Itchy Goat area at all times. You are strictly prohibited from wandering around the rest of the farm.

 

We expect that you will care for our animals and other visitors, staying calm and gentle with no aggressive behaviour. Anyone who we observe engaging in kicking, squeezing or excessively rough behaviour will be asked to leave immediately. If you are asked to leave, you must leave our property, not just the Itchy Goat area.

Children are to remain appropriately clothed at all times. Sunscreen, comfortable casual clothes and closed-in shoes that cover your toes are highly recommended. Parents are required to stay and supervise their children at all times during the sessions.

 

We are there to watch over the well-being of our animals. Your children are your responsibility.  Please ensure your kids do not mistreat our kids.

 

While our animals are used to being handled, they will still engage in natural behaviour. They poop when and where they want to, and if you stick fingers in their mouths, they may bite.

 

Please be aware of the potential for splinters, scratches and bumps as we are on a farm and this is an outside event. While we have done our best to ensure the safety of our enclosure, trip hazards may still exist, so it is essential to watch where you are walking.

 

Even the healthiest animals can carry germs, so practice sensible hygiene. We provide hand sanitiser and handwashing facilities for your use.

You are welcome to bring water with you, but human snacks are not healthy for our animals. It is essential that you check with us before feeding our animals anything which we have not provided for that purpose.

 

Under no circumstances are you allowed to take our animals home with you. Our animals are our pets. We love and care for them.

 

We are not an amusement park and do not provide rides of any kind. Our animals aren't trained to perform tricks for your amusement. You are coming into their space to interact with them and need to be considerate of their comfort and wellbeing.

 

We do not appreciate unsolicited advice about how to care for our animals from people who think they can protect our animals better than we do. We are very experienced animal owners who care lovingly for all our animals. Our animals receive routine vet checks and all appropriate medical treatment. We are also licensed by the DPI and comply with all of their best practice guidelines. If you don’t like how we do things, please keep it to yourself as we will not engage in debate with you.

 

Smoking is strictly prohibited except for the designated smoking area. As this is on a working farm, cigarettes are to be completely out and disposed of in the designated area only as we don’t want our animals to eat the butts.

 

From time to time, Itchy Goat Art may carry out photography and/or video recording around the farm, which may feature visitors. By accepting these Regulations, you agree that Itchy Goat Art or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever.

You further agree that copyright in these materials rests with Itchy Goat Art or such authorised party (as the case may be). If you do not wish to be included, please notify us.

 

Guide Dogs and Assistance Animals are permitted in accordance with section 9 of the Disability Discrimination Act 1992 (Cth). We reserve the right to exercise any exemptions under the Act, including if we suspect that the assistance animal has an infectious disease that may affect other patrons or the health of our animals. We also reserve the right to require evidence relating to your assistance animal or its training in accordance with section 54A(5) of the Act. To facilitate your ease of entry with an assistance animal, we strongly recommended you contact us at least 2 days prior to your visit so that we can discuss any arrangements or assistance that you may need from us.

 

However please remember this is a farm and please consider, your animal may be okay with strange animals but ours may become stressed with your unknown animal.

 

6. Late, missed & cancelled visits

We run specific morning or afternoon sessions at designated times. We stick strictly to these times to ensure we allow our animals sufficient rest and recovery time. If you are late for your session, you will still have to leave at the advertised time.

Any cancellations outside of 24 hours’ notice will allow a booking reschedule or cancelling with a refund request. Missed sessions with less than 24 hours’ notice will forfeit the booking cost because visitor places are limited and we have held that space open for you.

 

All tickets must be used within 3 months of the date of purchase.

 

We reserve the right to cancel and reschedule sessions due to bad weather, sick animals, or other unforeseen circumstances on the farm. We will contact you, giving as much notice as possible and offer you the opportunity to reschedule or refund your entry fee.

 

7. Covid

Safety Measures: In response to the Covid-19 pandemic, we have a number of specific safety measures in an effort to safeguard the health, safety and wellbeing of our visitors.

 

Visitor Requirements: It is in the interest of everyone to comply with the safety measures that have been put in place. Therefore, should an individual not comply with these safety measures, we reserve the right to require that individual to leave in accordance with these terms and conditions.

 

Acceptance of risk: The safety measures that are being and have been introduced are intended to minimise the risk of contracting the Covid-19 virus but this risk cannot be completely eradicated. Therefore, anyone visiting Itchy Goat Art acknowledges that they do so at their own risk.

 

8. Limitation of Liability

We do not make any guarantees or warranties about the availability of specific animals during your visit, as we will always put the needs of our animals first.

 

We take our obligations under Australian Consumer Law seriously and will do our best to address any issues that arise. However, even if there is a major problem, our liability is strictly limited to:

providing the services to you again; or

if we are unable to do so within a reasonable time, paying the cost of having the relevant services supplied to you again.

 

Subject to our obligations under Australian Consumer Law, we are not liable to you for any costs, loss, injury or damage that you may suffer that is not directly attributable to our negligence.

 

You agree that your visit to our property is entirely voluntary. You expressly agree to accept all reasonably foreseeable risk of injury or damage that may arise from your visit.

 

Itchy Goat Art accepts no responsibility for any loss and/or damage however arising (including that which might arise as a result of any breach of contract) including any distress, inconvenience or anxiety caused to visitors while at Itchy Goat Art.

 

You expressly agree that if this limitation of liability is unenforceable for any reason, our total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to us under this agreement.

 

9. Dispute Resolution

“We” below refers to everyone involved in the dispute.

This Agreement is subject to the governing law of New South Wales.

 

(a) Negotiation

If you have any concerns arising out of this agreement or your visit to our farm, we agree that we shall communicate with the intention of making a genuine effort to seek a win/win solution and resolve any dispute in good faith by negotiation and discussion.

 

We all agree that we will not engage in any public discussion about the issues in dispute, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests. We agree to act in good faith and be reasonably cooperative at all stages of the dispute resolution process.

 

(b) Mediation

If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not located within 100kms of each other.

 

The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of New South Wales or a similar neutral authority. We agree to share all the costs of mediation equally between us.

 

We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

 

All prices shown are in Australian Dollars (AUD).

 

Any credit card data gathered during online purchases is used purely for the purposes of the transaction and will not be stored permanently.

Itchy Goat Art - Booking Waiver Form

By signing this agreement, you acknowledge that you understand that this activity involves live farm animals that have come from a farm paddock and are not trained.

Our activity involves interacting with the animals and as such they may do normal bodily functions including peeing, pooping, chewing things they shouldn’t or if feeling distressed or cornered may bite.

Itchy Goat Art of Razorback, its owners, employees, representatives (hereinafter referred to collectively as “Employees”) have restricted the likelihood of bad behaviour occurring however sometimes like your kids, our kids may not behave the way we would like.  Your understanding is appreciated.

 

  1. I agree as a precondition to my participation in a petting zoo, kids’ activity, Birthday Party (hereinafter referred to collectively as the “Event”) organized by Itchy Goat Art and or its Employees, conducted by Itchy Goat Art or its Employees, and in further consideration of Itchy Goat Art allowing me to do so, to be strictly bound by the terms of this Waiver, Assumption of Risk and Indemnity Agreement (hereinafter referred to collectively as “This Agreement”).

  2. I acknowledge that any Farm Event can involve inherent risks that may cause serious injury and possibly death to participants.

  3. I fully understand the risks and dangers associated with me or my child(ren’s) participation, in The Event, and accept same entirely at my own risk.

  4. I hereby waive any and all claims, which I may have against Itchy Goat Art, and/or its Employees, and release Itchy Goat Art and its Employees from all liability for injury, death, property damage, or any other loss sustained by me or my child (or the child I am representing) as a result of my/their participation in the Event, due to any cause whatsoever including, without limitation, negligence on the part of Itchy Goat Art or its Employees, for any and all legal fees (on a solicitor and his own client basis) or costs, which may be incurred in defending any lawsuit or claim I may bring against them.

  5. I appreciate that This Agreement applies whether Itchy Goat Art is at fault or not and it limits the liability of The Employees to the same extent as it limits the liability of Itchy Goat Art even though The Employees are not formal parties to This Agreement. I understand, further, that Itchy Goat Art in securing execution of This Agreement by myself is acting as agent or trustee on behalf of or for the benefit of The Employees who shall to this extent be or be deemed to be parties to This Agreement.

  6. I have read and understand this agreement, I understand that this document contains an undertaking not to sue Itchy Goat Art or its Employees and release and indemnify same for all claims.
